Terms of Service

The rules and commitments that apply when you use MapStack. Please read them carefully — using the Service means you accept them.

The Short Version

These Terms of Service ("Terms") are a legal agreement between you and Fanyi Consultants, LLC ("MapStack," "we," "us," or "our"), the operator of the MapStack mobile application and related websites (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 17 years old to use MapStack. By using the Service, you represent and warrant that (a) you are at least 17, (b) you have the legal capacity to enter into this agreement, and (c) your use of the Service does not violate any applicable law.

Your Account

You create an account through Apple Sign-In or Google Sign-In. You are responsible for maintaining the security of the third-party account you use to sign in and for all activity that occurs under your MapStack account. Notify us immediately at info@mapstackapp.com if you suspect unauthorized access.

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms or create risk or legal exposure for MapStack or our users.

The Service

MapStack is a social discovery platform that lets you create, curate, share, and follow lists of places. We may add, modify, or remove features at any time. Some features may require location permissions, notifications, or other device-level access that you control.

Your Content

You own what you post

You retain all ownership rights to the content you create in MapStack — your lists, places, photos, notes, reviews, and any other content you contribute ("User Content").

You grant us a license to display it

To operate the Service, you grant MapStack a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting and display purposes only), publicly display, and distribute your User Content solely in connection with operating, promoting, and improving the Service. This license ends when you delete your User Content or your account, except where (a) we need to retain it to comply with law, (b) it has been shared with others who have not deleted it, or (c) it exists in standard backup systems.

You're responsible for your content

You represent that you have all necessary rights to the User Content you post and that it does not violate these Terms, third-party rights, or applicable law.

Acceptable Use

Zero tolerance for objectionable content and abusive users.

MapStack has zero tolerance for objectionable content — including but not limited to harassment, hate speech, sexually explicit material, threats, violence, and content that infringes on the rights of others — and for abusive behavior toward other users. Any user who posts objectionable content or who behaves abusively will have the offending content removed and may have their account terminated and banned from the Service without prior notice.

When using MapStack, you agree not to:

We may remove User Content and suspend or terminate accounts that violate these rules.

Reporting and our 24-hour response commitment

You can flag objectionable content or report an abusive user at any time. Every list, place, and user profile in the app has a "Report" option in its menu, and you can also block users directly from their profile or any of their lists. Blocking immediately removes that user's content from your feed.

You can also email reports to info@mapstackapp.com.

We commit to reviewing reports and acting on them — including removing offending content and ejecting offending users — within 24 hours of receipt.

Sponsored Placements

MapStack's business model is supported by sponsored placements — businesses that pay to have their locations featured in relevant contexts within the Service.

All sponsored placements are clearly labeled as "Sponsored" in the app. Organic (non-sponsored) results are ordered based on relevance, popularity, and user signals — not payment. Sponsored status does not affect user reviews, ratings, or list inclusions contributed by MapStack users.

Third-Party Services

The Service relies on third-party providers — including Apple, Google, Firebase, and Google Places — for authentication, hosting, analytics, and place data. Your use of those services is subject to their own terms and privacy policies. MapStack is not responsible for content or services provided by third parties, including the accuracy of place data returned by the Google Places API.

Intellectual Property

The Service — including its software, design, logos, and all content other than User Content — is owned by Fanyi Consultants, LLC or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted in these Terms.

"MapStack" and the MapStack logo are trademarks of Fanyi Consultants, LLC. You may not use them without our prior written consent.

Copyright and DMCA

We respect intellectual property rights. If you believe User Content on MapStack infringes your copyright, send a DMCA notice to info@mapstackapp.com including:

  1. Your physical or electronic signature;
  2. Identification of the copyrighted work claimed to be infringed;
  3. Identification of the allegedly infringing material and its location in the Service;
  4. Your contact information;
  5. A statement that you have a good-faith belief the use is not authorized; and
  6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act.

We may terminate the accounts of repeat infringers.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including violation of these Terms. Sections that by their nature should survive termination (including ownership, warranty disclaimers, liability limits, and dispute resolution) will survive.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied.

To the maximum extent permitted by law, MapStack disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or that place data will be accurate or current.

Limitation of Liability

To the maximum extent permitted by law, MapStack will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the Service.

MapStack's total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the amount you have paid to MapStack in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you in full.

Indemnification

You agree to indemnify and hold harmless Fanyi Consultants, LLC and its officers, directors, employees, and agents from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising out of (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third-party rights.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules.

Informal resolution first

Before filing a formal claim, you agree to contact us at info@mapstackapp.com and attempt to resolve the dispute informally for at least 60 days.

Binding arbitration

If we can't resolve the dispute informally, you and MapStack agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in Hamilton County, Ohio, or via remote proceedings where available. Either party may bring an individual claim in small-claims court instead.

Class action waiver

You and MapStack agree that disputes will be resolved only on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.

EU/UK users

Nothing in this Section limits mandatory consumer rights that cannot be waived under the law of your country of residence. If you are in the EU or UK, you may also bring a claim in the courts of your country of residence.

If you download MapStack from the Apple App Store, the following additional terms apply:

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you in the app or by email before the changes take effect. Your continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, you must stop using the Service.

Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and MapStack regarding the Service. If any provision is held unenforceable, the remaining provisions will continue in full effect. Our failure to enforce a right or provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
